WHAT IS A HOSTILE
ENVIRONMENT ON ACCOUNT OF SEX?
Generally, a hostile work environment on account of sex must be both
objectively and subjectively offensive, one that a reasonable person would
find hostile or abusive, and one that the employee in fact did perceive
to be so. Courts will look to all of the attendant circumstances,
including the frequency of the discriminatory conduct; its severity; whether
it is physically threatening or humiliating, or a mere offensive utterance;
and whether it unreasonably interferes with an employee's work performance.
The sex discrimination laws do not prohibit "genuine but innocuous differences
in the way men and women routinely interact with members of the same sex
and of the opposite sex". Simple teasing, offhand comments, sporadic
jokes, and isolated incidents (nless extremely serious) will not usually
amount to discriminatory changes in the terms and conditions of one's employment.
The anti-discrimination laws are not meant as codes of general civility
and only conduct which is extreme will amount to a change in the terms and
conditions of employment.
